1. Aceptación1. Acceptance

Al utilizar Conserje Virtual (en adelante, "el Servicio"), aceptás estos Términos de Servicio en su totalidad. Si no estás de acuerdo, debés abstenerte de utilizar el Servicio. El uso continuo del Servicio constituye aceptación de los términos vigentes y de sus futuras modificaciones. By using Conserje Virtual (the "Service") you accept these Terms of Service in full. If you do not agree, you must refrain from using the Service. Continued use constitutes acceptance of the current terms and any future modifications.

2. Descripción del Servicio2. Service Description

Conserje Virtual es un asistente conversacional que opera sobre la WhatsApp Business API de Meta. Su finalidad es responder consultas frecuentes de huéspedes en alojamientos turísticos (WiFi, horarios, accesos, recomendaciones) y proveer asistencia operativa al personal del alojamiento. El Servicio se brinda "tal como está" y puede evolucionar sin previo aviso. Conserje Virtual is a conversational assistant running on Meta's WhatsApp Business API. Its purpose is to answer common guest questions at short-term rentals (WiFi, schedules, access, local tips) and to support property staff operationally. The Service is provided "as is" and may evolve without prior notice.

3. Uso Permitido y Prohibido3. Permitted and Prohibited Use

Está permitido utilizar el Servicio para las finalidades descritas en la sección 2. Queda prohibido: You may use the Service for the purposes described in section 2. The following uses are prohibited:

• Enviar mensajes masivos no solicitados (spam) o contenidos en violación de las políticas de WhatsApp Business. Send unsolicited bulk messaging (spam) or content that violates WhatsApp Business policies.
• Recopilar datos personales de terceros sin su consentimiento. Collect personal data from third parties without their consent.
• Intentar acceder, alterar o degradar la infraestructura del Servicio (incluyendo pero no limitado a scraping automatizado, ingeniería inversa o ataques DoS). Attempt to access, alter or degrade the Service infrastructure (including but not limited to automated scraping, reverse engineering or DoS attacks).
• Utilizar el Servicio para actividades ilícitas, fraudulentas o que infrinjan derechos de propiedad intelectual. Use the Service for unlawful, fraudulent activities or activities that infringe intellectual-property rights.

4. Cuentas y Responsabilidades del Anfitrión4. Host Accounts and Responsibilities

El anfitrión que contrata el Servicio es responsable de: (a) la veracidad de la información que carga sobre su propiedad; (b) informar a sus huéspedes que la atención será asistida por inteligencia artificial; (c) atender las solicitudes de derechos del titular (ARCO) recibidas a través del canal y reenviarlas oportunamente cuando corresponda. The host engaging the Service is responsible for: (a) the accuracy of the information uploaded about the property; (b) informing guests that support is AI-assisted; (c) handling data-subject rights requests received through the channel and forwarding them when appropriate.

5. Propiedad Intelectual5. Intellectual Property

El código, marcas y diseño del Servicio son propiedad de Conserje Virtual. El anfitrión conserva la titularidad del contenido que carga sobre su alojamiento y otorga a Conserje Virtual una licencia no exclusiva y revocable para procesar dicho contenido con el único fin de prestar el Servicio. The Service's code, trademarks and design are owned by Conserje Virtual. The host retains ownership of the content it uploads about its property and grants Conserje Virtual a non-exclusive, revocable license to process such content solely to deliver the Service.

6. Limitación de Responsabilidad6. Limitation of Liability

El Servicio depende de proveedores externos (Meta, Google Gemini, Cloudflare R2, Railway). Conserje Virtual no garantiza disponibilidad ininterrumpida y no será responsable por daños indirectos, lucro cesante o pérdida de oportunidad derivados de interrupciones, errores en respuestas generadas por IA, fallas de terceros o caso fortuito. La responsabilidad máxima agregada se limita al monto efectivamente abonado por el anfitrión durante los 3 meses previos al hecho que motiva el reclamo. The Service relies on external providers (Meta, Google Gemini, Cloudflare R2, Railway). Conserje Virtual does not warrant uninterrupted availability and will not be liable for indirect damages, lost profits or loss of opportunity arising from outages, AI-generated response errors, third-party failures or force majeure. Aggregate maximum liability is capped at the amount actually paid by the host during the 3 months preceding the event giving rise to the claim.

7. Modificaciones del Servicio y los Términos7. Service and Terms Modifications

Conserje Virtual puede modificar funcionalidades, precios y estos Términos en cualquier momento. Los cambios sustanciales serán comunicados con razonable antelación a través del canal habitual con el anfitrión. El uso del Servicio luego de la entrada en vigencia implica aceptación de las nuevas condiciones. Conserje Virtual may modify features, pricing and these Terms at any time. Material changes will be communicated reasonably in advance through the usual channel with the host. Continued use of the Service after the effective date constitutes acceptance of the new conditions.

8. Privacidad8. Privacy

El tratamiento de datos personales se rige por la Política de Privacidad, que forma parte integrante de estos Términos. The processing of personal data is governed by the Privacy Policy, which is an integral part of these Terms.

9. Ley Aplicable y Jurisdicción9. Governing Law and Jurisdiction

Estos Términos se rigen por las leyes de la República Argentina, en particular la Ley 25.326 de Protección de Datos Personales. Cualquier controversia se someterá a los tribunales ordinarios de la Ciudad Autónoma de Buenos Aires. These Terms are governed by the laws of the Argentine Republic, in particular Personal Data Protection Law 25.326. Any dispute shall be submitted to the ordinary courts of the City of Buenos Aires (CABA).
